DISERTASI (323) - Pemenuhan Hak Atas Pendidikan Bagi Masyarakat Adit Di Indonesia
Indigenous people are the world‟s poorest, most marginalized and
disadvantaged people. Indigenous people are the same as other communities in
general, they are entitled to proper education for them. Proper education for
indigenous people is education whose contents and purpose are in accordance with
their needs. Education for indigenous people is still neglected and often not fully
implemented, so various problems occur in fulfilling the right to education for
indigenous people. The education system of indigenous people is based on
concepts, history and cultural values that are different from the education system in
general.
This research is normative legal research. The method used in this research
is statutory, conceptual and comparative approaches. The legal materials used as
sources of this research material consist of primary and secondary legal materials.
The results show that: Fulfillment of the right to education for Indonesian
indigenous people held through Special Education Service (PLK). PLK is an
affirmative action from the State to achieve equality for the education of
indigenous people. Fulfillment of the right to education for indigenous peoples in
Indonesia is carried out based on principles derived from the National Education
System Act, the Act on Ratification of ICESCR and the Presidential Decree on
Ratification of the Convention on the Rights of the Child.
