SKRIPSI (6586) - Distribution Of Goods Using Counterfeit Trademarks (Case Study Of High Court Decision Number 276/Pid.Sus/2023/Pt Bdg)
Trademark is one of the most important intellectual properties. A registered
trademark has high economic value as it is used by individuals or legal entities by
displaying them in the form of logos, images or writing. A registration is required
to obtain right to a trademark. With this right, owners may forbid any parties to use
the trademark for similar goods and/or services. It is also to prevent any goods using
counterfeit trademarks. In Indonesia, such goods are a serious problem that have an
impact on both customers and undertakings. The spread of goods using counterfeit
trademarks damages customer confidence and reputation of the company. These
goods are traded through a variety of channels, one of them is through the use of
online marketplace. It is regulated under Article 102 of Law Number 20 of 2016 on
Trademark and Geographical Indication in regards to its criminal penalties.
Trademark owners may also file a civil lawsuit as stipulated under Article 83 of the
aforementioned law.
