TESIS (4784) - Data Protection of the Deceased under the European Union Law Perspective
This research critically examines the existing loopholes and challenges within the GDPR concerning the protection of deceased individuals' data, highlighting the necessity for a unified approach to post-mortem data protection across the EU. The study explores the concepts of duty, obligation, and the nuanced interplay between rights and obligations in the context of the GDPR, proposing that data controllers should maintain normative obligations post-mortem. Employing a constructivist legal interpretation, the research emphasizes the importance of ethical and moral considerations in extending GDPR protections beyond death. The study further addresses the fragmentation issue by advocating for a dynamic harmonization approach, fostering dialogue and cooperation among member states, and implementing incremental harmonization steps. By examining national laws, ECtHR and CJEU jurisprudence, and data operators' post-mortem policies, the research proposes comprehensive guidelines to manage deceased individuals' data effectively. While the approaches to this research are multi-faceted, the methodologies employed are simply doctrinal and reform-oriented. The findings suggest that integrating ethical values into the legal framework and recognizing posthumous data protection are crucial for maintaining public trust and societal well-being in the digital age. The study concludes with practical recommendations for legislative amendments and enhanced judicial interpretations to bridge the identified gaps, ensuring consistent and robust protection for deceased individuals' data across the EU.
