In recent decades, the prevalence of transboundary environmental disputes has increased, prompting extensive discussions on the legal obligations under international environmental law concerning significant transboundary harm. A particularly underdeveloped area of this law is the obligation to provide reparations when these primary obligations are violated. A warding reparations for environmental damage resulting from significant transboundary harm has throughout history presented a challenge to international judicial bodies due to inherent scientific uncertainties and a lack of established rules for addressing such harm. This undergraduate thesis examines the evolution of public international law's approach to compensating environmental damage resulting from significant transboundary harm, comparing the approach in the 1941 Trail Smelter Arbitral Award to the 2018 Costa Rica v. Nicaragua International Court of Justice Judgment. The study explores how jurisprudence has shifted over time, particularly focusing on the transition from compensating only consequential environmental damage (such as agricultural and industrial economic losses), as seen in the Trail Smelter case, to recognizing the intrinsic value of the environment and providing compensation for pure environmental damage in the Costa Rica v. Nicaragua case. The research highlights the criticisms and recommendations from scholars regarding the adequacy of current legal frameworks and proposes future directions for refining the approach to environmental compensation. Through a doctrinal methodology and comprehensive literature review, this paper contributes to the ongoing discourse on enhancing legal accountability and effectiveness in remedying transboundary environmental damage.
