The concept of "Build, Operate And Transfer (BOT) developed into a system, it is
a concept that has certain advantages in the construction of office buildings. One of the
advantages of the system application is there’s a solution to the funding problem, the
owner can get a developer to be involved as funder without any probability of losing the
rights of the project or the building constructed. One of the public facilities in Central
Lombok which is constructed under the BOT contract is the construction of Praya
shopping complex on Jalan Gajah Mada, Praya. The agreement made between the Central
Lombok local government and PT Kosambi Victorylac. However, practically before the
term of the agreement is over, the investor namely PT Kosambi Victorylac divert the
object of the agreement to the third parties under a purchase agreement. Those things
certainly harmed the Central Lombok local government.
The case became an interesting phenomenon to be investigated further about how
is actually the relationship between the parties of the law of construction under BOT
agreement and the extent to the accountability of the BOT object’s diversion. In the
relation of those, the problems are solving used by normative or doctrinal approach which
is an approach that sees law as a doctrine or set of normative rules (law in book). The
approach is conducted through the assessment or research of law literature.
