The main issue in this research is about Issuance of Bonds by the Local
Government Company.
The type of this research is legal research. This research uses statute approach.
Statute approach is to reviewing all laws and regulations relating to the issuance of
bonds by local government company. Based on this approach is expected to provide
answers and a strong argument against the formulation of the problem.
From this research, it is found that the local government company was
established through Regulation of Local Government Areas who are giving services,
held a public benefit, and cultivate revenue. Local Company Property is property that
is separated from the wealth of the region. Company board of directors as the Region
in implementing its authority to accountability to the Head of the Region as a
shareholder. Based on the concept of obtaining capital and accountability procedures
for organ in the Local Company, explicitly apply the rules of private law, the
Regional Companies are private legal entities that carry out its business for public
purposes. Therefore, the type of bonds can be issued by a local government company
is corporate bonds.
The procedures to be followed in the issuance of bonds by the local
government company is equal to the issuance of corporate bonds in general. In the
event of default, the form of accountability that must be implemented by the local
government company is the fulfillment of achievement, ie the issuer must make
payments of principal and interest on bonds
