ABSTRACT
Discretion of the Head of Region in the Implementation of Regional Government that Implicates Deprivation
Discretion head of region that implicates public deprivation which is an economic
state have to be investigated first by the intern supervisor to decided if that
deprivation is caused by an administration error or a criminal act of corruption. If
based on investigation by intern supervisor found that the deprivation is caused by
administration mistake then it set an obligation to return the state losses and and also
imposed administrative sanctions based on the error rate that generated the loss. Other
state governor that doesn‟t agree with the decision made by the internal controller
could appealed to the administrative state court to verify the decision made by the
internal controller. If the court confirm intern supervisor decision then the regional
government is obliged to give a compensation whereas if the court granted the
appealed by the regional government then the intern supervisor decision is aborted.
On the contrary, if the intern supervisor found that the state loss is occured by a
criminal act of corruption than it will be handled to authorities law enforcer.
